Terms of Service

Acceptance

By creating an account you agree to these Terms. If you do not agree, do not use Daguerre.

The service

Daguerre provides software to manage photography studio operations: contacts, bookings, galleries, contracts, invoicing, and email correspondence.

Your account

You are responsible for keeping your credentials secure and for all activity on your account. You must be at least 18 years old or the age of majority in your jurisdiction.

Acceptable use

Do not upload illegal content, infringe third-party rights, send spam, attempt to disrupt the service, or use it for unlawful purposes. We may suspend accounts that violate these rules.

Your content

You retain ownership of all content you upload (photos, contracts, client data). You grant Daguerre a limited licence to host and process it solely to provide the service. We do not use your content to train machine-learning models and we do not share it with third-party AI services. See /legal/your-data for the operational detail.

Subscriptions and payments

Paid plans are billed in advance through Polar, which acts as Merchant of Record. Listed prices are inclusive of any applicable VAT or sales tax — Polar calculates and remits taxes on our behalf, so the price you see is the price you pay. You can pick monthly or yearly billing — yearly comes at a discount.

Cancellation and refunds

You can cancel at any time from Settings; cancellation takes effect at the end of the current billing period. EU consumers have a 14-day right of withdrawal for digital services unless they explicitly waive it on first use.

Termination

We may suspend or terminate accounts for material breach. You can export your data at any time from Settings → Export your data, and delete your account from Settings → Delete account. See /legal/your-data for details.

Warranty and liability

The service is provided on an "as is" basis. To the maximum extent permitted by law, Daguerre is not liable for indirect or consequential damages, and total liability is capped at fees paid in the preceding twelve months.

Fair use

Plans include reasonable use of bandwidth and per-gallery transfer. We may charge additional fees, throttle service, or require a plan upgrade for accounts that significantly exceed average usage. Current fair-use thresholds are published at /legal/fair-use and may be updated from time to time with reasonable notice.

Governing law

These Terms are governed by the laws of Slovenia. Disputes are subject to the exclusive jurisdiction of the courts of Ljubljana, without prejudice to mandatory consumer rights.

Changes

We may update these Terms; we will notify you of material changes. Continued use after the effective date constitutes acceptance.
